JUST IN : Rtd Captain Charles Byaruhanga Remanded To Luzira Over Fraudulent Sale of Late Dr James Garuga Land, Court Issues Criminal Summons Against Maguru, Hapa Nganwa

The Buganda Road magistrates grade one court has remanded to Luzira Retired captain Charles Byaruhanga to Luzira Prisons over the case of fraudulent sale of land belonging to late businessman Dr James Musinguzi Garuga.

Byaruhanga who was arrested on Tuesday was detained at Kira road police station where he was brought to court for the mention of his case.

He is charged alongside Agaba Maguru, Henry Hapa Nganwa for charges of fraudulent Transfer of Title contrary to section 174(1) Registration of Titles Act , False Statement by officials of a company or corporation contrary to section 303(1)(a) of the Penal Code Act in six counts against Agaba Maguru and Nganwa Henry Hapa and Conspiracy to defraud contrary to section 289 of the Penal Code Act against Agaba Maguru, Nganwa Henry Hapa and Byaruhanga Charles.

The cases read before court by prosecution indicates that on 16th July 2025, Byaruhanga (A3)a resident of Kikajo zone , Masajja division together with Agaba Maguru A1, Henry Hapa Nganwa A2, without valid board resolution and without lawful corporate authority and in contravention of subsisting supreme court injunction dated 17 November 2023 fraudulently executed sales and transfer forms in respect to land comprised in block 1004 plot 2 freehold register hectares LUW 38, folio 3 measuring approximately 849 hectares situated at Bulemezi, Ngoma , Nakaseke district.

The charge sheet also includes that Byaruhanga, Maguru, Byamugisha Ferdinand, Johnny Musinguzi, Peace Kesiime Bagorogoza , Philip Musinguzi and Rowena Musinguzi on the 16th July 2025 at Kampala without board authorization from INCAFEX limited and its subsidiary company, Garuga Properties limited conspired to defraud INCAFEX LIMITED of land comprised in BLOCK 1004 plot 2,freehold register volume LUW 38 folio 3,measuring Approximately 8.49hectares situated at Ngoma Bulemezi In Nakaseke district.

According to instructions from the director of public prosecutions, the investigators have been instructed to , Ensure that the Government Valuation Report in respect to the piece of land situate in Nakaseke Block 1004 Plot 2 at the time when Byaruhanga Charles acquired the same is retrieved and attached.

The Registrar of Titles in Bukalasa who effected the fraudulent transfer should be questioned on why he effected a transfer of company property without considering the provisions of the law regarding such a disposal.

The Government valuer who assessed the value the land during the transfer process should be questioned as regards the claim that he undervalued.

Conduct thorough investigations on a separate file in relation to the allegation of Stealing Cattle by tracing for witnesses who were working at the ranch mentioned by the complainants where heads of cattle were allegedly stolen.

Conduct thorough investigations on a separate file as regards the allegation of embezzlement and theft of funds for all the Companies as mentioned by Musinguzi Alwyn Garuga.

Inspection of the various Bank Accounts as per details provided and retrieving documents from Ministry of Finance and Bank of Uganda relating to all compensations to the Companies by the government.

Conduct thorough investigations on a separate file into the allegations of Intermeddling with the estate of the late Musinguzi James Garuga against Peace Kesiime Bagorogoza by verifying the facts/information provided by Musinguzi Alwyn Garuga and obtaining all relevant documents.

The status of each of the as mentioned properties to be ascertained by the Investigating team.

Ensure that Peace Kesiime and other family members are questioned as regards this specific allegation and establish whether or not the rest of the family members of the late Musinguzi James Garuga are involved.

Obtain and attach an inventory for the estate of the late Musinguzi James Garuga from the Administrator General who is currently administering the estate.

Trace for Johnson Matsiko to explain how he came to acquire land belonging to Incafex Ltd on Plot 2, Block 937 Kitantalo Kyambogo Bulemezi in Luwero District measuring approximately 2,567.7660 hectares.

Also establish the relationship between him and the other suspects specifically Agaba Maguru.

Carry out separate thorough investigations into the allegation of fraudulent acquisition of a leasehold title under LRV MKO2171 Folio for 99 years on personal property of Musinguzi James Garuga on Block 516 Plot 12, Kyaggwe Mukono District at Busanga Koome Island measuring approximately 296.74 hectares by Erunger Property Limited.

In this regard, the DPP wants the trace for the Directors of the said company and one Mugabe Ronald Ruranga who was a witness to the transaction and to establish the relationship between the said Mugabe and Agaba Maguru.

Conduct separate thorough investigations into the alleged fraudulent sale of the other company property i.e. a piece of land located in Entebbe Municipality.

Byaruhanga has been remanded to Luzira Prisons until 21 October when he will return to court for another mention of his case and court also issued criminal summons against Agaba Maguru and Henry Nganwa who are still on the run.
